This dissertation charts how the legal regulation of Islam in colonial India fostered a conception of religion that focused on dividing it from secular economy and politics. Colonial law segregated religious law from other branches of law through intersecting binaries that pitted religion against reason and family against the economy. These binaries continue to shape both popular and scholarly approaches to South Asian religion. Unsettling these common assumptions, the dissertation reveals the close relationship between contemporary conceptions of religion and the imperatives of imperial governance. By segregating religious from secular law, the British developed a bifurcated strategy of governance that balanced contradictory commitments to preserving Indian traditions with introducing modernizing reforms. Scholars have traditionally located the origins of the colonial approach to administering Indian religious laws in the early decades of Company rule. The dissertation argues instead that the conceptual framework of religious personal laws emerged between the second and third quarter of the nineteenth century. Changing concepts of sovereignty, an evangelical commitment to spreading Christian civilization, and the integration of colonial production into global markets led colonial officials to look for ways to consolidate the authority of the colonial state. Rather than “saving” the difficult fields of religion and philosophy for college curricula, it is instead developmentally appropriate for high school students—fourteen- to eighteen-year-olds—to engage the complex existential, ethical, and analytical challenges raised by these disciplines, especially as they pertain to the adolescent search to “know thyself” (Gr. γνῶθι σεαυτόν [gnōthi seauton]). This is explored in the context of unfolding trends in American education which downplay the importance of a humanities education in the overall curriculum, and with reference to models of adolescent psychology and pedagogical theory, drawing in particular upon my forty years of experience as a classroom teacher. In pursuit of this thesis, I argue for a more appropriate understanding of the definitions of religion and philosophy, as well as a more holistic understanding of the act of philosophizing. More traditional and restrictive definitions of religion need to be revised to embrace the view of the student as a person who is seeking meaning in a variety of situations and places, often outside of organized religion. En esta investigación nos propusimos indagar por la posibilidad y los senderos para elaborar una filosofía de la religión a partir de la fenomenología radical de Michel Henry. Para llevar a cabo nuestro propósito, explicitamos la duplicidad del aparecer como clave del pensamiento henriano, rastreamos la implementación de este principio en la filosofía del cristianismo propuesta por Henry, y exploramos su fecundidad de estos elementos en la comprensión de la vivencia religiosa. Mostramos que es posible encontrar una forma particular de considerar la religión en continuidad con esta fenomenología, porque en ella se pone de manifiesto una fenomenicidad específica desde la cual resulta concebible una vivencia originaria de lo absoluto que es, justamente, aquello que define la experiencia propiamente religiosa. Si es cierto, como sostiene Henry, que hay dos modos fundamentales de manifestación y que las realidades varían según sean leídas desde el mundo o desde la vida, hemos de aceptar, por lo menos a manera de hipótesis, que poner en operación este principio de duplicidad fenomenológica puede resultar enriquecedor en la comprensión de la religión en la complejidad de su manifestación vital y mundana. The most important recent development in American religion is the dramatic increase in the number of people who claim no religious affiliation — the rise of the Nones. In this Working Paper, I discuss the social factors that explain the rise of the Nones--demography, politics, family, technology, a distrust of institutions generally--and explain what this development might mean for the definition of religion in American law. I focus on a recent federal appeals court case involving a self-styled spiritual adviser, “Psychic Sophie,” who claimed that following her “inner flow” constituted a religion meriting constitutional and statutory protection. I argue that the case is a close one. Protecting Nones as a religion would promote the important goals of state religious neutrality and personal autonomy. On the other hand, religion has always been understood in terms of community. Indeed, as Tocqueville saw, it is precisely religion’s communal aspect that makes it so important to liberal democracy. Granting Nones the status of a religion would fail to capture this important social benefit.

Uno de los elementos de mayor divergencia entre la cultura occidental y la islámica lo constituye su distinto concepto de derecho: mientras que la fuente del derecho islámico es la religión, la del derecho occidental es el Estado laico. Por ello se examinan aquí algunos casos concretos de Estados islámicos (sobre todo Pakistán) y de convivencia entre derecho islámico y derecho europeo. Tiene especial interés la presencia de tribunales de sharía en Gran Bretaña, que han provocado como reacción el surgimiento del movimiento “One Law for All”. En el ámbito de los derechos fundamentales, la libertad religiosa de corte occidental encuentra dificultades casi insuperables en el Estado islámico, puesto que en el Islam se puede entrar pero no salir, a no ser con la muerte. Por ello, la apostasía constituye uno de los puntos de máxima dificultad para la convivencia de los dos sistemas jurídicos. Así pues, después de la “Primavera árabe”, muchas esperanzas occidentales se centran en el modo en que la religión islámica podrá conciliarse con la democracia y con el respeto a los tratados internacionales, sobre todo los relativos a derechos humanos. An assumption underpinning Western liberal democracy is that separation of religion and state always improves stability, and U.S. policy often encourages nations to move toward secular government structures. Yet, ethnically plural societies may need a common identity for the nation to gel and religion might be the glue that can hold a society together. Recent nation-building efforts signal a need for greater understanding of how best to employ religion as a cross-cutting tie for social cohesion. This thesis examines Israel, Iran, and Turkey; each has varying ethnic and religious compositions and has attempted to use religion for domestic stability. While Israel and Iran validate religion's cohesive power, all cases highlight the possible adverse effects of this approach. The findings of this thesis identify which political systems, religious contexts, population demographics, and/or political circumstances are most conducive for leveraging religion to aid domestic stability. We conclude that, while in many cases religion may increase volatility, in some circumstances religious glue may, actually, effectively bridge ethnic divisions to promote cohesion and stability. This study maintains that philosophical reflection on religion can avoid consigning the significance of religion to the secret of faith or sacrificing its significance at the threshold of intelligibility. Such reflection involves the unsettling of a traditionally respected heterogeneity between faith and knowledge---an unsettling announced by recent Continental philosophers yet still lacking rigorous exploration. Specifically in the context of the debates describing contemporary Continental philosophy of religion, an argument is needed to clear the space for thinking the interpenetration of faith and knowledge by becoming aware of the hyperbole that plagues these debates beholden to an inflated alterity. The task of this study, then, is to pull back from hyperbolic claims that have rendered the religious amazing in order to clear the space to think through this amazement as it finds expression. The effort to witness this possibility inhering in the Continental reflection on religion finds motivation in the recent reconsiderations of the phenomenon of art. The engagement with the artwork as enigmatic, possessing significance beyond the confines of the philosophical discipline of aesthetics, presents a model for thinking through the alterity of religious themes and phenomena. Pushing the philosophy of art to respond to the recent theological preoccupation with alterity offers a model for consideration of otherness in Continental philosophy of religion. A significant and growing number of authors and commentators have proposed that ecologically enlightened (‘greened’) religion is the solution or at least a major part of the solution to the global ecological crisis. These include Birch, 1965 p90; ... . Proponents offer a variety of reasons for this view, including that the majority of the world’s and many nations’ people identify themselves as religious, and that there is a large amount of land and infrastructure controlled by religious organisations worldwide. However, the most important reason is that ‘religion’ is said to have one or more exceptional qualities that can drive and sustain dramatic personal and societal change. Esse trabalho tem como objetivo comparar Durkheim e Weber, os quais representam figuras emblemáticas nos estudos das sociedades ocidentais modernas, na tentativa de aproximar suas teorias sociológicas à religião. Procuramos destacar, a partir dos estudos epistemológicos e metodológicos deles, alguns elementos que podem nos levar a destacar pontos convergentes e divergentes, tentando explorá-los para ressaltar certa aproximação. Para tanto, no primeiro capítulo expomos uma comparação entre religião e magia, levando em conta noções como sacrifício, culto e rito. Essa comparação tem como objetivo mostrar, de um lado, que em Durkheim ambas são fenômenos sociais e que, por outro lado, em Weber a religião se revela mais racional do que a magia, considerada como uma atividade irracional. Portanto, esse capítulo seria uma articulação em torno da natureza social e racional da religião em relação à natureza social e irracional da magia. 7th World Conference on Educational Sciences, (WCES-2015), 05-07 February 2015, Athens, Greece.; The relationship between science and religion has been marked by historically constructed movements of proximity and conflict. We have investigated how high school biology teachers from three countries with different relationships between State and religion, Argentina, Brazil and Uruguay, conceive the science-religion relationship. Uruguay has consolidated secularism, Argentina has an official religion and Brazil calls itself secular, but its secularism is only relative. Fifty high school biology teachers from each country answered the European BIOHEAD-CITIZEN data collection questionnaire, which investigates teachers' conceptions of biological evolution, health, sexuality, and other topics. The question used was "Should science and religion be separate?" Conflict, independence, dialogue and integration categories were considered in the analysis and the results were submitted to parametric testing. Most Uruguayan high school biology teachers tended to agree with the investigated question, with a lower ratio in Brazil, followed by Argentina. This article is based on the line of argument that in Kant there is a bold and original interpretation of religion, which is made from a clearly philosophical hermeneutic viewpoint. This will have precise consequences on the ethical commitment of every human being, and the interactions that can be established between philosophy, religion, theology and human sciences in general. Kant’s perspective is marked by Pietism, and his particular reading of the Bible, and in this sense there is also conjecture that its interpretation is full of nuances and is very detailed, which, if at any moment establishes a position which is critical of religious discourse, it does so because it seeks to be consistent with its own religious nature. La intención de Bergson, en su obra “Las dos Fuentes de la Moral y la Religión”, es la de mostrar de qué manera la aparición del cristianismo y su posterior consolidación en el universo occidental marca un quiebre en la historia humana de manera que significa un “salto” evolutivo espiritual y social. Espiritual por inaugurar una nueva actitud en relación a la sociedad y a la humanidad (la de la acción y el amor) y social por cuanto esta situación habría posibilitado el surgimiento de una nueva forma de organización social, cual sería la democracia y la representación parlamentar en el Estado Moderno, presentándose como la forma más cercana a una sociedad de la apertura. Ambas situaciones históricas se auto afirman y condicionan, sociedad cerrada-religión estática, sociedad abierta-religión dinámica. La división entre religión estática y dinámica estaría dada por la función que la religión desempeña en la sociedad. En la sociedad primitiva la religión surge como prevención al temor que provoca lo desconocido y su función es la de servir como dispositivo contra el poder disolvente de la inteligencia, que haría aparecer el egoísmo del individuo y produciría la desintegración social, por lo tanto esta primera función estaría encuadrada en el orden de la conservación social. La segunda función sería la de servir como dispositivo contra la depresión por el poder de la inteligencia de representarse la inevitabilidad de la muerte. Por su parte la religión dinámica habría abierto el universo espiritual del hombre al encarnarse en la religión cristiana la ideología del amor por la humanidad y su función sería la de mantener este horizonte siempre abierto (merced a la propagación del ímpetu o impulso místico) y aumentar así cada vez más los niveles de libertad y de indeterminación de la especie. OBJETIVO: Compreender a concepção de saúde e a origem do sofrimento psíquico por adeptos de uma comunidade tradicional de terreiro. PROCEDIMENTOS METODOLÓGICOS: Estudo de caso qualitativo realizado em uma comunidade tradicional de terreiro na cidade de Porto Alegre (RS), entre 2007 e 2008. Foram participantes o sacerdote/Babalorixá e seis adeptos do terreiro. Para a coleta dos dados e construção do corpus de análise, foram realizadas entrevistas abertas, gravadas e transcritas. A categorização dos depoimentos, a partir do enfoque sistêmico complexo, possibilitou a construção de dois eixos temáticos: 1) terreiro e concepção de saúde e 2) origem do sofrimento psíquico e identidade cultural. ANÁLISE DOS RESULTADOS: Na comunidade de terreiro, as terapêuticas tradicionais em saúde, como o uso de ervas, banhos, dietas e/ou ritos de iniciação foram associados a terapêuticas convencionais propostas pelo Sistema Único de Saúde. Consideram em sua concepção etiológica do sofrimento psíquico e em sua concepção de saúde os vínculos e a pertença a um território, as relações entre os sujeitos e a relação entre suas dimensões física, psíquica e espiritual. Este trabajo se caracterizó como cualitativo, de abordaje exploratorio; tuvo como objetivo conocer la percepción de los académicos del mestrado en enfermería acerca de la religión como recurso terapéutico en el proceso de recuperación del ser humano enfermo y su familia. El camino seguido tuvo como referencial metodológico Mynaio (1996). La población fue compuesta por 14 estudiantes del mestrado. Para la colecta de datos, fue utilizado cuestionario. De las informaciones, emergieron las categorías "religión mientras apoyo personal", "religión y cuidado de enfermería", "religión como recurso terapéutico" y "utilizando la religión en la práctica del cuidado de enfermería". It is widely accepted among secularisation theorists (Wilson 1966,1982; Dobbelaere, 1981; Berger 1981; Bruce, 1999,2002) that the more modern a society becomes, the more likely it is to secularise - i.e. the social and political significance of religion will most likely diminish. At the opposite end of the theoretical debate, scholarly work seeking to explain the recent phenomenon of the re-affirmation of religious values argues that the consequence of modernisation is not secularisation but rather the resurgence of religion (Huntington, 1996; Kepel, 1994; Juergensmeyer, 1993, 2000). With religion gaining salience in some societies but losing ground in others, this ongoing debate appears more critical than ever. The cases of Ireland and Greece are pertinent examples: The Republic of Ireland is experiencing secularising tendencies and the legitimacy of the Church is being increasingly challenged, while in Greece the role of religion remains strong, if not strengthened in recent years, and the legitimacy of the Church is maintained. For secularisation theorists, failure to secularise is likely in instances where there is an explicit link between religion and nationalism-'Cultural defence' or the 'nationalist pattern' (Martin, 1978). Religion is back in Philosophy as a respectable subject. Part 1 first charts what MacIntyre, Taylor and Derrida have meant in this regard. Subsequently, it turns to the Enlightenment to determine what constituted the breakthrough. It is found that even where the Enlightenment gave maximum room to religion (i.e. as a civic religion and as "religion of the heart") it still excluded a constitutive relation to a transcendent revelation. Part 2 centres on the religion-faith distinction in reformational philosophy. Similar to the Enlightenment, religion is understood as part of human nature. However, human nature itself is conceived as intrinsically religious and depending for its light on revelation. Secondly, "religion" in this context also encompasses idols and religious substitutes. Thus, it directs attention to shopping malls, football stadiums, health policy, et cetera, as possible contexts of a return of religion. Examples show that this has become a popular approach. However, most of the publications surveyed fail to distinguish between an "analogical" and a "pistically qualified" use of religion, and are open to exaggerations (the shopping mall and football stadiums as temples, etc.). At this junction, the relevance is shown of the religion-faith distinction as well as of Elaine Botha's theory of metaphors. The epilogue offers an integration of parts one and two.

The complex and problematic role of religion in the public sphere in modern, democratic societies raises many questions for a public theology. The aim of this article is to contribute to the ongoing debate about the task and methods of public theology by asking what we can learn from the ideas of Jürgen Habermas. Habermas was a leading participant in the thinking process on the secularisation thesis in Western societies. His view was that religion will eventually disappear from the public scene due to the rationalisation of society. In recent years he seems to have changed this view in the light of new developments in the world. He now maintains that religion has something important to offer in the public sphere. Religion could thus participate in this public discussion, provided that it satisfies strict conditions. We argue that public theology can learn from Habermas's recent ideas regarding religion in the public sphere: attention should be paid to the cognitive potential of religion, especially regarding the importance of the lifeworld and the role of religion in social solidarity with the needy and vulnerable; hermeneutical self-reflection is important; a distinction should be made between the role of religion in faith communities and in public life; we have to accept that we live in a secular state; and we have to learn the possibilities and impossibilities of translating from religious vocabulary into a secular vocabulary in order to be able to participate in the discussions in the public sphere.
